1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the VYSER website, storefront, and any related services (collectively, the "Site"), and any purchase of products offered through it. The company is organized under the laws of the State of Wyoming, United States ("VYSER," "we," "us," or "our").

By accessing, browsing, or purchasing from the Site, you agree to be bound by these Terms and by our Privacy Policy, Refund & Return Policy, and Shipping Policy, each incorporated here by reference. If you do not agree to these Terms, you must not access or use the Site.

We may update these Terms at any time. Changes take effect when posted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from the Site. If you are a minor, you may use the Site only with the involvement and consent of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your activity. By placing an order, you represent that you meet these requirements and that all information you provide is accurate and complete.

3. Products, Descriptions & Availability

We sell fashion eyewear and related accessories. We work to display our products, colors, and details as accurately as possible; however, we do not warrant that product descriptions, images, colors, dimensions, or other content are complete, current, or error-free. Actual product appearance may vary due to screen settings, photography, lighting, and manufacturing variation.

All products are subject to availability. We reserve the right, without liability, to limit quantities, discontinue any product, or correct any error, inaccuracy, or omission at any time — including after an order has been submitted.

4. Fashion Eyewear Notice (Important)

Our eyewear is sold as fashion and lifestyle accessories. Unless a specific product listing expressly states otherwise:

Our products are not prescription eyewear, medical devices, safety eyewear, or personal protective equipment.
Our products are not intended to diagnose, treat, or prevent any medical or vision condition.
Any sun-protection, UV, glare, or similar characteristic mentioned in a listing is a general product feature and is not a medical or safety guarantee.
You are responsible for determining whether a product is suitable for your intended use. Do not use our eyewear for activities requiring certified protective or corrective eyewear (including but not limited to driving in low visibility, operating machinery, sports, or occupational safety) unless the listing certifies it for that use.

To the fullest extent permitted by law, we disclaim all liability arising from use of our products for any purpose beyond ordinary fashion and lifestyle wear.

5. Pricing & Payment

All prices are listed in the currency shown at checkout and are subject to change without notice. We reserve the right to correct pricing errors even after an order is placed; if a product's correct price is higher than the price shown, we may cancel the order or contact you before shipping.

You agree to provide current, complete, and accurate purchase and account information. Payment is processed by third-party payment providers; by submitting payment information, you authorize us and our providers to charge the applicable amount, including taxes and shipping. We do not store your full payment card details.

6. Order Acceptance & Cancellation

Your submission of an order is an offer to purchase. We are not obligated to accept any order and may, at our sole discretion and without liability, refuse, cancel, or limit any order — including for suspected fraud, resale, pricing errors, stock issues, or violation of these Terms. If we cancel an order after payment, we will issue a refund for the affected items.

7. Shipping, Delivery, Customs & Duties

We ship internationally. Estimated processing and delivery times are provided in our Shipping Policy and are estimates only, not guarantees. Delivery timeframes vary by destination country and by factors outside our control, including carrier delays, customs clearance, weather, and local conditions.

Once an order is handed to the carrier, risk of loss passes to you. You are the importer of record for your order and are solely responsible for any customs duties, import taxes, tariffs, brokerage fees, or other charges imposed by your country. We have no control over these charges and cannot predict their amount. Refusal to pay such charges, or refusal of delivery, does not entitle you to a refund of shipping costs.

8. Returns & Refunds

Returns and refunds are governed by our Refund & Return Policy, which is incorporated into these Terms. In summary, eligible items may be returned within 14 days of delivery, and we offer free returns for eligible items. Please review the full Refund & Return Policy for conditions and exclusions.

9. Intellectual Property

The Site and all of its content — including the VYSER name, KRUX Culture LLC marks, logos, designs, product imagery, text, graphics, and layout — are owned by or licensed to us and are protected by intellectual-property laws. You may not copy, reproduce, republish, distribute, modify, or create derivative works from any part of the Site without our prior written consent. Nothing on the Site grants you any license or right to our intellectual property.

10. Prohibited Uses

You agree not to use the Site: (a) for any unlawful purpose; (b) to infringe our or others' rights; (c) to transmit malware or interfere with the Site's operation or security; (d) to scrape, data-mine, or use automated systems to access the Site; (e) to submit false information or engage in fraudulent transactions; (f) to resell products without authorization; or (g) to harass, abuse, or harm others. We may terminate or restrict your access at any time for any violation.

11. User Content & Reviews

If you submit reviews, comments, images, or other content, you grant us a non-exclusive, royalty-free, worldwide, perpetual, transferable license to use, reproduce, display, and distribute that content in connection with our business and marketing. You represent that your content is accurate, is yours to share, and does not violate any third-party rights or applicable law. We may remove any content at our discretion.

12. Third-Party Links & Services

The Site may contain links to third-party websites or services (including payment processors and carriers). We do not control and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

13. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any product will meet your expectations. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KRUX CULTURE LLC, VYSER, AND OUR OFFICERS, MEMBERS, EMPLOYEES, AGENTS, SUPPLIERS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, arising out of or related to your use of the Site or any product, whether based in contract, tort, strict liability, or any other theory, even if advised of the possibility of such damages.

IN NO EVENT WILL OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR A PRODUCT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless KRUX Culture LLC, VYSER, and our officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) any content you submit.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.

Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product — except as noted below — shall be resolved by final and binding arbitration administered on an individual basis, rather than in court. The arbitration shall be conducted in the English language. Judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver. You and we agree that any proceedings will be conducted only on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative action. You waive any right to a jury trial and to participate in a class action.

Exceptions. Either party may bring an individual claim in small-claims court, and we may seek injunctive relief to protect our intellectual property.

Time Limit. Any claim must be brought within one (1) year after it arises, or it is permanently barred, to the extent permitted by law.

17. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, pandemics, government action, labor disputes, carrier or supplier failures, customs delays, or internet or infrastructure outages.

18. Severability & Waiver

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of our right to do so later.

19. Entire Agreement

These Terms, together with our Privacy Policy, Refund & Return Policy, and Shipping Policy, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements.
